EXPERTS FORM COMPETITION COMMISSION OF INDIA IMPARTING TRAINING ON COMPETITION POLICY AND LAW

     Aiming to provide Members of Myanmar Competition Commission, officials from Commission Office and relevant Ministries with a comprehensive insight into the legal framework, experiences and best practices in Indian Competition Law, training programme on Competition Policy and Law imparted by experts from Competition Commission of India (CCI) is being conducted from 3rd to 6th June, 2024 at Myanmar Competition Office, Nay Pyi Taw.

     Myanmar Competition Commission Member, Dr.Thuta Aung, gave a welcome address and Advisor (Law) to CCI, Mr. Ved Prakash Mishra, gave an introductory remark at the training.

     Three experts from CCI are imparting training to the mid-level officials from Ministry of Commerce, Legal Advisory Unit of MoC, Commission Office and relevant Ministries.

(Full News)

1.       Wednesday Talk was held at the conference hall of the department of trade under the Ministry of Commerce, office No. 3, on May 29, 2024, from 10:00 am to 11:45 am.

2.       U Nyi Nyi Aung, Director of the WTO and International Trade Related Organizations Divisions of the Department of Trade, presented the topic of “World Trade Organization’s 30- year journey and presenting a vision of near and far.”

3.       Daw Moe Moe Thwe, Director General of the Department of Intellectual Properties, complemented discussion about the “World Trade Organization’s 30-year journey and presenting a vision of near and far” and Daw Ni Ni Kyaw, Deputy Director General, of the Myanmar Trade Promotion Organization, presented a gift of honor to U Nyi Nyi Aung, and then Daw Moe Moe Thwe, Director General, gave a closing speech.

4.       In conclusion, the Wednesday Talk discussion was attended by the Director and Deputy Director of the Department of Trade, the Director and Deputy Director of the Department of Consumer Affairs,the Director General,the Deputy Director General of the Intellectual Property,and then Deputy Director General of the Myanmar Trade Promotion Organization, as well as 184 participants from the Ministry of Commerce.

THE 11THASEAN FRAMEWORK AGREEMENT ON COMPETITION (AFAC) NEGOTIATION

The 11th ASEAN Framework Agreement on Competition (AFAC) Negotiation was virtually held on 29May 2024.

The Meeting was held in plenary and attendedby all ASEAN Member States (AMS), and the ASEAN Secretariat. The Meeting waschaired by Ms. Lolibeth Ramit-Medrano, Commissioner of the Philippine CompetitionCommission (PCC), Chair of the AFAC Negotiation.

The meeting considered and negotiated on the draft text, focusing on concluding the negotiation of Article 9 “Confidentiality of Information”, Article 10 “Technical Assistance and Capacity Building”, and Article 11 “Micro, Small and Medium Enterprises”.

The Meeting agreed on the work plan and discussed the preparation for the 12th AFAC Negotiation to be held from 13-14 June 2024 in Manila, Philippines.

The Second Meeting of the ASEAN-China Working Group on Supply Chain Connectivity, part of the ASEAN-China Free Trade Agreement (ACFTA) 3.0 Upgrade Negotiations

    The Second Meeting of the ASEAN-China Working Group on Supply Chain Connectivity, part of the ASEAN-China Free Trade Agreement (ACFTA) 3.0 Upgrade Negotiations, was held on 20-21 May 2024, at the ASEAN Secretariat, Jakarta, Indonesia virtually.

     The 43 representatives from ASEAN member states and China attended the meeting via video conferencing. The two representatives from Ministry of Commerce of Myanmar attended the said meeting via video conferencing.

    The Meeting discussed the structure of the Chapter on SCC and agreed to first discuss the text and then later decide on the placement of some articles subject to the agreed scope of the Supply Chain Connectivity. The meeting agreed to add article on definitions and requested ASEAN Member states to explore additional terms and definition to be incorporated into this article. The meeting noted that ASEAN Secretariat will provide updates to the Special Joint Committee (SJC) ASEAN Caucus of the 6th Round of the ACFTA Upgrade Negotiations on the progress on the appointment of ASEAN Co-Chair of the WG-SCC and progress on the discussion of the draft text of Chapter on SCC.

   တီထွင်မှုမူပိုင်ခွင့်ဆိုင်ရာ အသိပညာပေးဆွေးနွေးပွဲကို ယနေ့နံနက် ၁၀ နာရီအချိန်တွင် စီးပွားရေးနှင့်ကူးသန်းရောင်းဝယ်ရေးဝန်ကြီးဌာန၊ မူပိုင်ခွင့်ဦးစီးဌာန၊ ရုံးအမှတ် (၅၂)၊ အစည်းအဝေးခန်းမ၌ ကျင်းပရာ မူပိုင်ခွင့်ဦးစီးဌာန ညွှန်ကြားရေးမှူးချုပ်က အဖွင့်အမှာ စကားပြောကြားသည်။

  အဆိုပါ တီထွင်မှုမူပိုင်ခွင့်ဆိုင်ရာအသိပညာပေးဆွေးနွေးပွဲသို့ ဖိတ်ကြားထားသည့် ဝန်ကြီးဌာနများမှ ညွှန်ကြားရေးမှူးချုပ်များ၊ ဒုတိယညွှန်ကြားရေးမှူးများ၊ ညွှန်ကြားရေးမှူးများ၊ အရာထမ်း ကိုယ်စားလှယ်များနှင့် အဖွဲ့အစည်းများမှ တာဝန်ရှိသူများ၊ မူပိုင်ခွင့်ဦးစီးဌာနမှ ညွှန်ကြားရေးမှူးများနှင့် တာဝန်ရှိသူများ စုစုပေါင်း(၁၂၀)ဦးခန့် တက်ရောက်ကြသည်။

   အဆိုပါ အသိပညာပေးဆွေးနွေးပွဲတွင် ညွှန်ကြားရေးမှူးချုပ် ဒေါက်တာမိုးမိုးသွယ်က အဖွင့်အမှာစကားပြောကြားရာ၌ မြန်မာနိုင်ငံတွင် အကောင်အထည်ဖော်ဆောင်ရွက်နေသည့် မူပိုင်ခွင့်အမျိုးအစားများထဲမှ တီထွင်မှုမူပိုင်ခွင့်စနစ်အကြောင်းကို သိရှိနိုင်စေရန်နှင့် တီထွင်မှုမူပိုင်ခွင့်စနစ်ကို ထိထိရောက်ရောက်အသုံးချပြီး နိုင်ငံဖွံ့ဖြိုးတိုးတက်စေရေးဆောင်ရွက်နိုင်ရန် ရည်ရွယ် ကျင်းပရခြင်းဖြစ်ပါကြောင်း၊ တီထွင်မူပိုင်ခွင့်စနစ်သည် တီထွင်ဖန်တီးနိုင်မှုကို အားပေးခြင်းဖြင့် ဆန်းသစ်တီထွင်မှုများတိုးတက်ရုံသာမက မြန်မာနိုင်ငံ၏ စီးပွားရေးတိုးတက်မှုနှင့် ဖွံ့ဖြိုးတိုးတက်မှုအတွက် ထောက်ပံ့ပေးနိုင်ခြင်း၊ တီထွင်မှုမူပိုင်ခွင့်စနစ်ကို ကျင့်သုံးဆောင်ရွက်နိုင်ပါက တီထွင်မှုများကို အကာအကွယ်ပေးနိုင်ခြင်း၊ နည်းပညာ၊ ရင်းနှီးမြှုပ်နှံမှု၊ ကုန်သွယ်ရေးနှင့်ကူးသန်းရောင်းဝယ်ရေးလုပ်ငန်းများ ဖွံ့ဖြိုးတိုးတက်နိုင်ခြင်း၊ အလုပ်အကိုင်အခွင့်အလမ်းများ များပြားလာနိုင်ခြင်း၊ ပြည်သူများ၏ အကျိုးစီးပွားများ မြင့်မားတိုးတက်လာနိုင်ခြင်းစသည့် အကျိုးကျေးဇူးများ  ရရှိလာနိုင်မည်ဖြစ်ပါကြောင်း၊

   မြန်မာနိုင်ငံတွင် တီထွင်မှုမူပိုင်ခွင့်ဥပဒေကို ကမ္ဘာ့ကုန်သွယ်မှုအဖွဲ့(World Trade Organization) ၏ မူပိုင်ခွင့်အခွင့်အရေးများဆိုင်ရာ သဘောတူစာချုပ်(Trade Related Aspects of Intellectual Property Rights–TRIPs)၏ အနိမ့်ဆုံးသတ်မှတ်ချက်များနှင့်အညီ ရေးဆွဲပြဋ္ဌာန်းထားပြီး TRIPs သဘောတူစာချုပ်ပါ ဖြေလျော့မှုများကို နိုင်ငံ၏ စီးပွားရေး၊ လူမှုရေးနှင့် ဖွံ့ဖြိုးတိုးတက်မှု အခြေအနေများနှင့်လျော်ညီစွာ အသုံးပြုနိုင်ရေး ထည့်သွင်းပြဋ္ဌာန်းထားပါကြောင်း၊ တီထွင်မှု မူပိုင်ခွင့်ဥပဒေပါ TRIPS ဖြေလျော့မှုများကို သိရှိနားလည်ပြီး နိုင်ငံဖွံ့ဖြိုးတိုးတက်ရေးကို အထောက်အကူဖြစ်စေမည့် အသုံးပြုမှုများ အထူးသဖြင့် ဆေးဝါး၊ ကုန်ထုတ်လုပ်မှုနှင့် စိုက်ပျိုးရေးကဏ္ဍများတွင် ပြည်ပနည်းပညာများ ရယူအသုံးပြုနိုင်ရေး၊ ဆေးဘက်ဆိုင်ရာသုတေသနများကို ထောက်ပံ့ပေးနိုင်ရေး၊ နိုင်ငံတော်အတွက် မရှိမဖြစ်လိုအပ်မည့် ဆေးဝါးများရရှိစေရေးနှင့် ပြည်သူ့ကျန်းမာရေးကို အထောက်အပံ့ဖြစ်စေမည့် အစီအစဉ်များ ချမှတ်နိုင်ရေးတို့အတွက် ဆောင်ရွက်စေလိုပါကြောင်း ပြောကြားခဲ့သည်။

    ဆက်လက်၍ မူပိုင်ခွင့်ဦးစီးဌာန ညွှန်ကြားရေးမှူး ဒေါက်တာပွင့်ဖြိုးဝင်းက မြန်မာနိုင်ငံ တီထွင်မှုမူပိုင်ခွင့်စနစ်နှင့်စပ်လျဉ်း၍ လည်းကောင်း၊ တီထွင်မှုမူပိုင်ခွင့်စနစ်ကို ထိရောက်စွာအသုံးပြုခြင်းနှင့်စပ်လျဉ်း၍ လည်းကောင်း ရှင်းလင်းဆွေးနွေးပြောကြားခဲ့သည်။ ထို့နောက် ဆွေးနွေးပွဲသို့ တက်ရောက်လာသူများက သိရှိလိုသည်များကို မေးမြန်းခြင်းများအပေါ် ဘာသာရပ်တာဝန်ခံက ပြန်လည်ရှင်းလင်းဖြေကြားခဲ့ပြီး ဆွေးနွေးပွဲကို ရုပ်သိမ်းခဲ့ကြောင်း သတင်းရရှိသည်။

The Seventh Meeting of the ASEAN-Canada Free Trade Agreement-Working Group on Trade in Services (ACAFTA-WGTIS)

   The Seventh Meeting of the ASEAN-Canada Free Trade Agreement-Working Group on Trade in Services (ACAFTA-WGTIS) was held in Jakarta, Indonesia, from 6 to 10 May, 2024. The meeting was attended by representatives from all ASEAN Member States,the ASEAN Secretariat Officeand Canada. The three representativesfrom Department of Trade, Ministry of Commerce, Myanmarhave attended the meeting via video conferencing system.

   The meeting had discussed on the draft text of Trade in Services/ Cross-Border Trade in Services,Temporary Movement of Natural Persons(TMNP), Annex on Development and Administration of Measures, Annex on Professional Services and its work plan. The ASEAN member states and Canada agreed to continue the discussion on the draft text during the next meeting accordingly.

THE ASEAN CAUCUS FOR THE SXTH MEETING OF THE WORKING GROUP ON COMPETITION FOR THE ASEAN-CANADA FREE TRADE AGREEMENT

       The ASEAN Caucus for the 6th meeting of the Working Group on Competition (WGC) for the ASEAN-Canada Free Trade Agreement (ACAFTA) was virtually held on 7th May 2024.     

       The meeting discussed the outstanding issues in the competition chapter; agreed follow-up actions of the 5th ACAFTA WGC; Consumer Protection Chapter to be included in the ASEAN-Canada Free Trade Agreement and work plan for the ACAFTA Negotiations.

       Representatives from the Competition Sector in ASEAN Member States and the ASEAN Secretariat Office attended the meeting.

ဈေးကွက်စီးပွားရေးစနစ် ကျင့်သုံးဆောင်ရွက်ကြသော နိုင်ငံများတွင် ယှဉ်ပြိုင်မှုဥပဒေသည် အဓိကအရေးပါသော ဥပဒေတစ်ရပ်ဖြစ်ပါသည်။ သို့ပါ၍ ဥပဒေသည် ခေတ်နှင့်လျော်ညီ‌စေရန် ဥပဒေ၏ အားသာချက်၊ အားနည်းချက်များအား အစဉ်တစိုက် လေ့လာသုံးသပ်ရေးနှင့် ယှဉ်ပြိုင်မှုဥပဒေ၊ နည်းဥပဒေများ ပြင်ဆင်ရေးဆွဲနိုင်ရေးအတွက် “ယှဉ်ပြိုင်မှုဥပဒေ၊ နည်းဥပဒေများ ပြင်ဆင်ရေးဆွဲရေး ဆိုင်ရာ လေ့လာစိစစ်သုံးသပ်ရေးအဖွဲ့”ကို ဖွဲ့စည်းခဲ့ပါသည်။

   The First Meeting of the ASEAN-China Working Group on Supply Chain Connectivity, part of the ASEAN-China Free Trade Agreement (ACFTA) 3.0 Upgrade Negotiations, was held on 22-23 April 2024, at the ASEAN Secretariat, Jakarta, Indonesia.

  The representatives from ASEAN member states and China attended the meeting physically. The 20 representatives from ASEAN countries attended the meeting via video conferencing. The two representatives from Ministry of Commerce of Myanmar attended the said meeting via video conferencing.
